TERMINI E CONDIZIONI  

1. Accettazione delle condizioni generali di vendita e conclusione del contratto
1.1 Il contratto stipulato tra Officina N.11 e il Cliente (ossia il soggetto, persona fisica, che effettua l’acquisto sul Sito, non riferibili alla propria attività commerciale, imprenditoriale o professionale) deve intendersi concluso con l’accettazione, anche solo parziale, dell’ordine da parte di Officina N.11. Nel caso di mancata accettazione dell’ordine, Officina N.11 provvederà a darne in ogni caso tempestiva comunicazione al Cliente.

1.2 Effettuando un ordine nelle varie modalità previste, secondo il form di ordine presente sul Sito, il Cliente dichiara di aver preso visione di tutte le indicazioni a lui fornite durante la procedura d’acquisto e di accettare integralmente le presenti condizioni generali.

1.3 Le presenti Condizioni possono essere stampate o salvate su supporto durevole, nel rispetto di quanto previsto dall’art. 12 del D.Lgs. 70/2003 e dall’art. 51 del D.Lgs. 206/2005, così come modificato dal D.Lgs. 21/2014.

2. Modalità di acquisto
2.1 I prodotti offerti in vendita da Officina N.11 sono unicamente quelli presenti sul sito di Officina N.11 al momento dell’inoltro dell’Ordine, così come descritti nelle relative schede informative.

2.2 Resta in ogni caso inteso che le immagini a corredo della scheda descrittiva di un prodotto sono ad esclusivo scopo informativo e possono non essere perfettamente rappresentative delle sue caratteristiche ma differire ad es. per colore e dimensioni (anche in ragione del browser e del monitor utilizzati per l’accesso al Sito e la visualizzazione delle immagini).

2.3 Il Cliente, per effettuare un Ordine, dovrà compilare in ogni sua parte il relativo form presente sul Sito ed inviare il medesimo dopo aver attentamente visionato le Condizioni, nonché le caratteristiche del prodotto e/o dei prodotti che intende acquistare. Il Cliente dovrà altresì richiedere a Officina N.11, ove la desideri, l’emissione di fattura fiscale relativa all’acquisto, ai sensi dell’art. 22 D.p.R. n. 633/1972.
Ai sensi dell’art. 22, comma 1, n. 1), del D.P.R. 633/72 e dell’art.2, del D.P.R. n 696/1996, nell’ambito delle vendite per corrispondenza non sussiste l’obbligo né di emissione della fattura, né di emissione dello scontrino o della ricevuta fiscale.

2.4 La corretta ricezione dell’Ordine è confermata da Officina N.11 mediante una risposta via e-mail, inviata all’indirizzo di posta elettronica comunicato dal Cliente. Tale messaggio di conferma riporterà sinteticamente le condizioni di acquisto, come previsto dalla normativa applicabile, nonché i dati inseriti nell’Ordine dal Cliente, affinché lo stesso possa verificare gli stessi ed eventualmente comunicare senza ritardo le necessarie correzioni di dati errati.

3. Prezzi e Modalità di pagamento
3.1 I prezzi indicati sul sito sono da considerarsi comprensivi delle tasse e dell’IVA. Eventuali costi di spedizione o spese di pagamento vengono in ogni caso comunicati preventivamente al Cliente attraverso il sito o le presenti Condizioni.

3.2 Sono previste le seguenti modalità di pagamento:
1) PayPal  Per il pagamento può essere utilizzato dal cliente il circuito Paypal secondo le modalità specifiche dello stesso.
2) Carta di credito  Nei casi di acquisto della merce con modalità di pagamento Carta di Credito, la transazione potrà avvenire attraverso il server sicuro Paypal o altro server sicuro prescelto da Officina N.11. n nessun caso ed in nessuna fase del pagamento Officina N.11 sarà in grado di conoscere le informazioni relative alla carta di credito del Cliente, trasmesse tramite connessione protetta direttamente al sito dell’istituto bancario che gestisce la transazione. Nessun archivio informatico di Officina N.11 conserverà tali dati e pertanto in nessun caso Officina N.11 potrà essere ritenuta responsabile per l’eventuale uso fraudolento e indebito di carte di credito da parte di terzi all’atto del pagamento.
3) Bonifico (solo per paesi dell’Unione Europea)  In caso di acquisto con bonifico, verranno visualizzate le coordinate bancarie per il pagamento. La spedizione della merce avverrà solo alla ricezione effettiva del pagamento in banca.

4. Consegna dei prodotti e relative spese
4.1 I prodotti acquistati verranno consegnati all’indirizzo indicato dal Cliente nell’Ordine entro 24-48 ore dall’accettazione dell’Ordine da parte di Officina N.11, al costo indicato specificamente nel Sito prima dell’invio dell’Ordine. Officina N.11 si riserva la facoltà di accettare o meno consegne richieste fuori dai confini italiani o europei. In ogni caso, per consegne da eseguirsi fuori dai confini italiani, le spese di spedizione ed i tempi di consegna potrebbero subire variazioni.
4.2 Relativamente alle consegne richieste in paesi non appartenenti all’Unione Europea, eventuali spese doganali di importazione saranno a carico del destinatario. Si invita pertanto il Cliente a contattare preventivamente le autorità doganali del proprio paese per verificare i costi e gli eventuali limiti di importazione.
4.3 I tempi di consegna indicati da Officina N.11 devono considerarsi come puramente indicativi ed un ritardo rispetto agli stessi, ovvero l’eventuale consegna effettuata con successive spedizioni frazionate non legittimano il Cliente al rifiuto della consegna medesima ed alla richiesta di risarcimenti o indennizzi.
4.4 Al momento della consegna dei prodotti, il Cliente è tenuto a controllare:
• che il numero dei colli in consegna corrisponda a quanto indicato nel documento di trasporto.
• che l’imballo risulti integro, non danneggiato, né bagnato o comunque alterato, anche nei materiali di chiusura (nastro adesivo o reggette metalliche).
Eventuali danni all’imballo e/o al prodotto o la mancata corrispondenza del numero dei colli o delle indicazioni, dovranno essere immediatamente rilevati, apponendo una specifica indicazione sul documento di consegna del prodotto da riconsegnarsi al corriere. ventuali problemi inerenti l’integrità fisica, la corrispondenza o la completezza dei prodotti ricevuti devono essere segnalati entro 7 giorni dalla avvenuta consegna, secondo le modalità previste nel presente documento.

5. Diritto di recesso
5.1 Ai sensi dell’art. 52 del D. Lgs. 206/2005, così come modificato dal D.Lgs. 21/2014, il cliente potrà recedere dal contratto di acquisto per qualsiasi motivo, senza necessità di addurre motivazioni e senza alcuna penalità, entro quattordici giorni lavorativi dalla data di ricevimento dei prodotti. Saranno a carico del cliente costo della spedizione di reso e responsabilità in caso di smarrimento. Occorre comunque segnalare l’intenzione di rendere l’oggetto acquistato all’indirizzo mail: info@officinanumeroundici.com.
Seguiranno le istruzioni per il reso e, una volta ricevuto il prodotto integro, non mancante di parti e non danneggiato, il rimborso.
5.2 In caso di recesso il Cliente dovrà reinviare a sue spese i prodotti a Officina N.11 entro 14 (quattordici) giorni dal recesso medesimo, al seguente indirizzo: Officina N.11 – Via Evangelista Torricelli 11, 48018 Faenza (RA) Italia.
5.3 La merce dovrà essere restituita integra, completa di tutte le sue parti e negli imballi originali (buste e confezioni), custodita ed eventualmente adoperata per il tempo strettamente necessario per stabilirne e verificarne natura, caratteristiche, secondo la normale diligenza, senza che vi siano segni di usura o sporcizia, nel rispetto delle condizioni di seguito riportate:

il diritto di recesso potrà applicarsi al prodotto acquistato nella sua interezza; non è infatti possibile esercitare recesso solamente su parte del prodotto acquistato (es.: accessori, complementi, ecc…);
perché il recesso sia possibile, il prodotto dovrà essere integro e restituito nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: etichette, cartellini, tags, sigilli, ecc…);
le spese di spedizione(ed eventuali spese doganali, se presenti) per la restituzione del bene saranno ad esclusivo carico del Cliente.
la spedizione, fino all’attestato di avvenuto ricevimento presso Officina N.11, è sotto la completa responsabilità del cliente;
in caso di danneggiamento del bene durante il trasporto, Officina N.11 ne darà comunicazione al Cliente, per consentirgli di sporgere tempestivamente denuncia nei confronti del corriere da lui scelto ed ottenere il relativo rimborso; il prodotto sarà quindi messo a disposizione del Cliente, contemporaneamente annullando la richiesta di recesso;
Officina N.11 non risponderà in nessun modo per danneggiamento, furto, smarrimento occorsi durante o comunque in dipendenza della spedizione per la restituzione.

5.4 Officina N.11 provvederà a rimborsare al Cliente l’intero importo già pagato, al netto degli eventuali costi supplementari di spedizione ai sensi dell’art. 56, comma 2, del D. lgs. 21/14, entro 14 (quattordici) giorni dal recesso, tramite procedura di storno dell’importo addebitato, utilizzando lo stesso mezzo di pagamento utilizzato dal Cliente per la transazione iniziale, salvo diverso accordo. In ogni caso, il Cliente non sosterrà alcun costo quale conseguenza di detto rimborso tranne le spese di spedizione (ed eventuali spese doganali, se presenti) per la restituzione del bene che resteranno ad esclusivo carico del Cliente.
5.5 In ogni caso, il Cliente decadrà dal diritto di recesso nei casi in cui Officina N.11 accerti che:

il prodotto restituito e/o i suoi accessori, e/o la sua confezione non sono integri;
il prodotto è mancante della sua confezione esterna e/o dell’imballo interno originale;
il prodotto è mancante di elementi integranti lo stesso e/o accessori (ad. Es. chiusure, lacci, fibbie, ecc.).

Nel caso di decadenza del diritto di recesso, Officina N.11 provvederà a restituire al mittente il prodotto acquistato, addebitando allo stesso le spese di spedizione e, ove già rimborsato, il prezzo del prodotto.

6. Garanzia  
6.1 Tutti i prodotti venduti da Officina N.11 sono garantiti a vita per i difetti di conformità. Per fruire dell’assistenza, il Cliente dovrà conservare la fattura, ovvero la ricevuta di pagamento.
6.2 La garanzia per difetti di conformità si applicherà purché il relativo prodotto sia stato utilizzato correttamente, nel rispetto della sua destinazione d’uso.

7. Reclami e richiesta di informazioni 
Ogni eventuale reclamo o richiesta di informazione potrà essere indirizzato a Officina N.11 ai seguenti recapiti:

8. Privacy 

I dati personali raccolti con l’inoltro dell’Ordine verranno trattati da Officina N.11 al solo fine di soddisfare le espresse richieste del Cliente, nel rispetto del Regolamento EU 2016/679 e dell’informativa privacy presente sul sito. Eventuali ulteriori trattamenti verranno effettuati unicamente con l’espresso consenso del Cliente. 9. Legge applicabile
 Il contratto di vendita di cui alle presenti Condizioni e la relativa esecuzione e regolato dalla Legge Italiana, con la disapplicazione delle norme di conflitto e della Convenzione delle Nazioni Unite per la Vendita Internazionale di Beni. Per la soluzione delle relative controversie sarà competente il Tribunale del comune di residenza del Cliente.

GENERAL CONDITIONS OF SALE

 1. Acceptance of the General Conditions of Sale and conclusion of the contract
1.1 The contract stipulated between Officina N.11 and the Client (that is the party or individual who makes the purchase on the Website, not attributable to their commercial, business or professional activity) shall be concluded with the acceptance, including partial acceptance, of the order by Officina N.11. Should the order not be accepted, Officina N.11 shall in any case provide prompt notification to the Client.  

1.2 By placing an order through one of the available methods, according to the order form on the Website, the Client confirms having read all the information provided during the purchase process and confirms full acceptance of these General Conditions.

 1.3 These Conditions may be printed or saved on a durable medium, in accordance with the provisions of Article 12 of Italian Legislative Decree 70/2003 and Article 51 of Italian Legislative Decree 206/2005, as amended by Italian Legislative Decree 21/2014.

 2. Purchase method
2.1 The only products offered for sale by Officina N.11 are those shown on Officina N.11’s website at the time of placing the Order, as they are described on the relevant information pages.  

2.2 However, it shall be understood that the images accompanying the information regarding a product are shown for information purposes only and may not be wholly representative of the product’s features, possibly differing, for example, in colour and size (in some cases due to the browser and screen used to access the Website and view the images).  

2.3 To place an Order, the Client must fully complete the relevant form on the Website and send the same after carefully reading the Conditions as well as the features of the product and/or products that the Client intends to purchase. The Client shall also ask Officina N.11, if desired, to send a tax invoice for the purchase, pursuant to Article 22 of Italian Presidential Decree no. 633/1972.

  2.4 Correct receipt of the Order shall be confirmed by Officina N.11 by means of a reply via email sent to the email address indicated by the Client. Said confirmation message shall include a summary of the purchase conditions, in accordance with applicable regulations, as well as the details provided by the Client on the Order, so that the Client may check said details and communicate any necessary corrections without delay.

 3. Prices and Payment Methods
3.1 The prices indicated on the Website shall be understood as inclusive of taxes and VAT. Any delivery costs or payment charges shall in any case be notified to the Client via the Website or through these Conditions.  

3.2 The following payment methods are accepted:
 1) PayPal Clients may pay via PayPal in accordance with the specific methods set by the same.  

2) Credit card Where products are purchased using a credit card, the transaction may be performed via thePayPal secure server or another secure server as chosen by Officina N.11.
Under no circumstances and at no stage of the transaction shall Officina N.11 be able to access the Client’s credit card details, which shall be transmitted through a secure connection directly to the banking institute that manages the transaction. No electronic record of said details shall be held by Officina N.11 and therefore under no circumstances shall Officina N.11 be held liable for any fraudulent and unauthorised use of credit cards by third parties at the time of payment.

3) Bank Transfer (Only for EU countries) In case of purchase with bank transfer, the Client can find the bank coordinate. The goods will be shipped only after the actual receiving of the payment.

4. Delivery of products and associated charges
4.1 The products purchased shall be delivered to the address indicated on the Order by the Client within 24-48 hours from Officina N.11 having accepted the Order, at the cost specifically indicated on the Website before placing the Order. Officina N.11 reserves the right to accept or refuse requests for delivery beyond the territories of Italy or Europe. In any case, for deliveries outside the territories of Italy, delivery expenses and lead times may be subject to change.  

4.2 With reference to requests for deliveries to countries that do not belong to the European Union, any customs duty for importation shall be payable by the consignee. The Client is therefore advised to contact the customs authorities in the country concerned beforehand to verify the costs and any restrictions on imports.  

4.3 The lead times for delivery indicated by Officina N.11 are merely indicative and a delay to the same, or any delivery made with subsequent split consignments shall not entitle the Client to refuse the delivery or request compensation or indemnity.  

4.4 At the time of delivery, the Client shall be required to check:
• that the number of packages delivered corresponds to the number shown on the delivery note.
• that the packaging is intact, not damaged, or wet or spoiled, including with reference to the materials used for sealing (adhesive tape or metallic strapping).
Any damage to the packaging and/or to the product or any lack of correspondence in the number of packages or the details, must be notified immediately by indicating the nature of the problem on the delivery note for the product, which shall be returned to the carrier. Any problems with reference to the physical integrity, correspondence or completeness of the goods received must be notified within 7 days of delivery, in accordance with the methods set out in this document.

5. Right to cancel
5.1 Pursuant to Article 52 of Italian Legislative Decree 206/2005, as amended by Italian Legislative Decree 21/2014, the Client may withdraw from the Conditions and therefore from the purchase agreement for any reason, without need for an explanation and without incurring any penalty, within 14 (fourteen) working days from the date of receiving the products. The instructions for the return will follow and, once the product is received intact, with no parts missing and not damaged, the refund.

5.2 In the event of cancellation, the Client shall return the products to Officina N.11 at the Client’s expense within 14 (fourteen) days of said cancellation to the following address:

5.3 The goods must be returned intact, complete in all their parts and in their original packaging (envelopes and packaging), having been kept and used only for the time strictly necessary to establish and verify their condition, features and size, in accordance with normal diligence, there being no signs of wear or dirt and in compliance with the following conditions:
• the right to cancel may be applied to the purchased product as a whole; it is not in fact possible to return only part of the purchased product (for eg., accessories, complementary items, etc.);
• in order to cancel, the product must be complete and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories: labels, cards, tags, seals, etc.);
• transport expenses (and any customs duty, if applicable) arising from the return of the goods shall be borne exclusively by the Client.
• until confirmation of receipt by the warehouse indicated by Officina N.11 is given, liability for transport shall be borne solely by the Client;
• should the goods be damaged in transit, Officina N.11 shall notify the Client, in order that the Client may promptly lodge a complaint against the courier that was used and obtain appropriate compensation; the product shall then be made available to the Client, at the same time as cancelling the request for termination;
• Officina N.11 shall not be liable in any way for damage, theft or loss that occurs during or as a result of a shipment made for the purposes of returning goods.

5.4 Pursuant to art. 56, paragraph 2 of Italian Legislative Decree 21/14, Officina N.11 will refund Customers for the entire amount already paid net of any additional shipping costs within 14 (fourteen) days of the return being made. The amount paid will be sent back to the Customer using the same payment method used for the initial transaction, unless another agreement has been reached. In any case, the Customer will not bear any costs relating to the refund of returned goods with the exception of shipping costs (and any customs expenses) which will be borne entirely by the Customer.

 5.5 In any case, the Client shall forfeit the right to cancel should Officina N.11 discover any of the following:
• that the returned product and/or its accessories, and/or its packaging are not intact;
• that the product is without its external package and or the original internal packaging;
• that the product is missing some of its integral parts and/or accessories (for eg., fastenings, ties, buckles, etc.).
Should the right to cancel be forfeited, Officina N.11 shall arrange to return the purchased product to the sender, debiting the shipping costs from the same and, if already refunded, the price of the product.

 6. Warranties  
6.1 All products sold by Officina N.11 are guaranteed for life against conformity defects. To benefit from assistance, the Client must retain the invoice or the payment receipt.  

6.2 The warranty for lack of conformity shall be applicable provided that the product concerned has been used correctly, in accordance with its intended use.

 8. Privacy
  Personal details collected when the Order is placed shall be used by Officina N.11 solely for the purpose of fulfilling the express requests of the Client, in accordance with EU 2016/679 and the privacy statement shown on this website. Any other use of said details shall take place only with the express consent of the Client.

 9. Applicable law 
The contract for sale set out in these Conditions and its performance shall be governed by Italian Law. Any contrary legal norms and the United Nations Convention on Contracts for the International Sale of Goods shall not be applicable. Should a dispute arise, it shall be submitted to the jurisdiction of the Courts in the town where the Client is resident.
